On January 21, 2004 the Oakland Planning Commission approved construction of the two-story Kirin restaurant at 5362 College Avenue, where Crème de la Crème was located. The RCPC Board and Land Use Committee had opposed the project due to parking, traffic, library usability, noise, odor, and restaurant saturation concerns. The developer sized the building at 2,950 sq ft — 50 sq ft short of the threshold requiring 10 parking spaces. The commission limited seating to 100 and directed staff to work with residents and business owners on parking.

Maezono Architecture presented a proposal for a new 3,000 square-foot, two-story restaurant in the building where Crème de la Crème recently operated, seating nearly 150 people with no parking spaces provided. The RCPC voted to oppose the plan and wrote a letter of opposition to the city planner and Councilmember Brunner.
